Don't Trust Your Gut - Seth Stephens Davidowitz - Bog - Bloomsbury Publishing PLC - Plusbog.dk

THE NEW BOOK FROM THE BESTSELLING AUTHOR OF EVERYBODY LIES '' Don’t Trust Your Gu t is a tour de force — an intoxicating blend of analysis, humor, and humanity'' DANIEL H. PINK ''Seth Stephens-Davidowitz is an expert on data-driven thinking, and this engaging book is full of surprising, useful insights for using the information at your fingertips to make better decisions'' ADAM GRANTBig decisions are hard. We might consult friends and family, read advice online or turn to self-help books for guidance, but in the end we usually just do what feels right. But what if our gut is wrong? As economist and former Google data scientist Seth Stephens-Davidowitz argues, our gut is actually not that reliable – and data can prove this. In Don’t Trust Your Gut, he unearths the startling conclusions that the right data can teach us about who we are and what will make our lives better. Over the past decade, scholars have mined enormous datasets to find remarkable new approaches to life’s biggest self-help puzzles, from the boring careers that produce the most wealth, to old-school, data-backed relationship advice. While we often think we know how to better ourselves, the numbers, it turns out, disagree.Telling fascinating stories through the latest big data research, Stephens-Davidowitz reveals just how wrong we really are when it comes to improving our lives, and offers a new way of tackling our most consequential choices.

The Final Test - Huw Turbervill - Bog - Bloomsbury Publishing PLC - Plusbog.dk

The Final Test - Huw Turbervill - Bog - Bloomsbury Publishing PLC - Plusbog.dk

‘[A] compelling book… Test cricket is hanging on. It’s a worry’ – Graham Gooch ''Huw Turbervill is the ultimate passionate polemicist for the Test format with a zeal that manages to weave both George Orwell and Basil Fawlty into his arguments'' – David Gower OBE ''As cricket expands into ever more formats and franchise leagues, more and more voices are to be heard; but the editor of The Cricketer should always be listened to'' – Scyld BerryThe editor of The Cricketer goes on a soul-searching journey to discover what the future holds for Test cricket. As T20 grows like Japanese knotweed, Test cricket is in mortal danger. White-ball tournaments – mainly T20 and T10 – are now sprouting in places like the US and Saudi Arabia, and Test cricketers are commonly being offered all-year-round contracts by IPL owners, allowing them to play short-form tournaments in the West Indies, the UAE and elsewhere. The IPL has expanded, but Australia''s Big Bash is contracting; the 2023 men''s Ashes were concertinaed into a tiny window but The Hundred continues to dominate. Is there still hope for Test cricket in this tumultuous sporting landscape? Turbervill recalls the poignancy of the final Test of the English summer at The Oval in 2022, and describes how the match could be seen as a metaphor for the demise of the longer game.As cricket fans seem divided in the sport''s own version of the culture wars: traditionalists refusing to accede territory; pragmatists wanting to achieve a healthy balance and progressives conceding the change, Turbervill asks cricketers, commentators and writers about the future of Test cricket. With guest appearances including David Gower, Graham Gooch, Merv Hughes, Reece Topley and many more, this book reveals if Test cricket can truly survive the next decade.

The Proportionality Test in European Patent Law - Leon Dijkman - Bog - Bloomsbury Publishing PLC - Plusbog.dk

The Proportionality Test in European Patent Law - Leon Dijkman - Bog - Bloomsbury Publishing PLC - Plusbog.dk

Does a European patent always entitle its holder to a permanent injunction? This question has sparked vigorous debate in past years but so far remains unresolved. This open access book presents a detailed, practical, and comprehensive test to determine when injunctive relief should be limited on proportionality grounds. The book''s 3 parts guide readers from proportionality''s normative foundations to its practical applications. Part I argues that, contrary to conventional wisdom, proportionality is not an open-ended balancing test but rather applies the principle of commensurate scope at the remedies stage. Part II offers an in-depth analysis of situations where a permanent injunction risks upsetting that principle. It draws on a unique qualitative study of all US District Court decisions between 2006 and 2020 granting or denying a permanent injunction in patent cases to stake out circumstances where an injunction might have disproportionate consequences. Part III grounds the inquiry in EU law and proposes a proportionality test along three elements: overreach, abuse, and conflicts with third-party rights. The book thus provides a distinctly European response to a global problem. The book is an invaluable resource for practitioners, clerks, and scholars looking not only for the normative, empirical, and legal basis of proportionality in European patent law, but also for guidance on its real-world operation. The ebook editions of this book are available open access under a CC BY-NC-ND 4.0 licence on bloomsburycollections.com .
