This book explores the incorporation of untranslated fragments from various languages within modernist writing. It studies non-translation in modernist fiction, poetry, and other forms of writing, with a principally European focus and addresses the following questions: what are the aesthetic and cultural implications of non-translation for modernist literature? How did non-translation shape the poetics, and cultural politics, of some of the most important writers of this key period?This edited volume, written by leading scholars of modernism, explores American, British, and Irish texts, alongside major French and German writers and the wider modernist recovery of Classical languages. The chapters analyse non-translation from the dual perspectives of both ''insider'' and ''outsider'', unsettling that false opposition and articulating in the process their individuality of expression and experience. The range of voices explored indicates something of the reach and vitality of the matter of translation--and specifically non-translation--across a selection of poetry, fiction, and non-fictional prose, while focusing on mainly canonical voices. Together, these essays seek to provoke and extend debate on the aesthetic, cultural, political, and conceptual dimensions of non-translation as an important yet hitherto neglected facet of modernism, thus helping to re-define our understanding of that movement. It demonstrates the rich possibilities of reading modernism through instances of non-translation.

This book is the first to present a comprehensive theory of non-canonical questions, those question types that do not (only) request information from the addressee, but rather (additionally) tell us something about the speaker''s epistemic and/or emotional state, such as can''t-find-the-value questions, echo questions, rhetorical questions, and surprise questions. While much recent research has explored the formal semantics and the phonetics and phonology of both canonical and non-canonical questions, the literature is still lacking a comprehensive account from a syntax-pragmatics perspective that brings together the multiple findings and strands of research from the last twenty years.The standard view in the syntax-pragmatics literature is that most special interpretations of non-canonical questions involve syntactic projections at or even above the level of illocutionary force. In this work, Andreas Trotzke argues that this approach is a mistake, and proposes a new alternative theory of non-canonical questions in which both their special pragmatics and their syntax, as well as in many cases their emotive component, can be derived solely from propositional-level operators that do not affect the illocutionary level of utterances and can be found across illocutionary forces. This account dramatically simplifies the syntactic analysis of non-canonical questions and is also able to capture some previously unobserved data in the discourse behavior of those question types.

The threats to human rights posed by non-state actors are of increasing concern. Human rights activists increasingly address the activity of multinational corporations, the policies of international organizations such as the World Bank and the World Trade Organization, and international crimes committed by entities such as armed opposition groups and terrorists. This book presents an approach to human rights that goes beyond the traditional focus on states and outlines the human rights obligations of non-state actors. Furthermore, it addresses some of the ways in which these entities can be held legally accountable for their actions in various jurisdictions.The political debate concerning the appropriateness of expanding human rights scrutiny to non-state actors is discussed and dissected. For some, extending human rights into these spheres trivializes human rights and allows abusive governments to distract us from ongoing violations. For others such an extension is essential if human rights are properly to address the current concerns of women and workers. The main focus of the book, however, is on the legal obligations of non-state actors. The book discusses how developments in the fields of international responsibility and international criminal law have implications for building a framework for the human rights obligations of non-state actors in international law. In turn these international developments have drawn on the changing ways in which human rights are implemented in national law. A selection of national jurisdictions, including the United States, South Africa and the United Kingdom are examined with regard to the application of human rights law to non-state actors. The book''s final part includes suggestions with regard to understanding the parameters of the human rights obligations of non-state actors. Key to understanding the legal obligations of non-state actors are concepts such as dignity and democracy. While neither concept can unravel the dilemmas involved in the application of human rights law to non-state actors, a better understanding of the tensions surrounding these concepts can help us to understand what is at stake.

This volume offers a detailed analysis of the issues related to the protection of non-traditional marks. In recent years, the domain of trademark law and the scope of trademark protection has grown exponentially. Today, a wide variety of non-traditional marks, including colour, sound, smell, and shape marks, can be registered in many jurisdictions. However, this expansion of trademark protection has led to heated discussions and controversies about the impact of the protection of non-traditional marks on freedom of competition and, more generally, on socially valuable use of these or similar signs in unrelated non-commercial contexts. These tensions have also led to increasing litigation in this area across several jurisdictions. This book provides an overview of the debate and state of the law surrounding non-traditional marks at the international, regional, and national level. In particular, this book addresses relevant international treaties administered by the World Intellectual Property Organization (WIPO) and the Agreement on Trade-Related Aspects to Intellectual Property Rights (TRIPS) as well as several regional and national legislations and leading judicial decisions in order to examine current law and practice culminating in critical reflections and suggestions on the topic.This is an open access title available under the terms of a CC BY-NC-ND 3.0 licence.
