The development model followed by the military regime that came to power in Brazil in 1964 is one of the most controversial among the less developed countries. The regime’s authoritarian structure, combined with a GNP growth rate that is one of the highest in the world, raises extremely disturbing yet fundamental questions about the relation between political authoritarianism and economic dynamism. In this book, social scientists from three continents assess the major political and economic characteristics of the Brazilian model. Because events there have important implications for other countries, throughout the volume there is a deliberate search for new conceptual frames of reference to help put the Brazilian process in a larger comparative perspective. Because of the important normative issues raised by the Brazilian style of development, there is also an attempt to be explicit about what values the regime promotes and what values it denies. Each of the contributors is a distinguished scholar in his field. They are Fernando Henrique Cardoso, Alber Fishlow, Juan J. Linz, Samuel Morley, Philippe C. Schmitter, Thomas E. Skidmore, Gordon W. Smith, and Alfred Stepan. From their different perspectives, they help us to understand how political repression and economic boom have gone hand in hand in this important Latin American country.

Although evenly matched adversaries make for a more exciting athletic contest, and a level playing field is essential to a fair game, is the same true in a criminal trial? In this compelling new book, H. Richard Uviller argues that a criminal trial is not analogous to a sporting event. Prosecutors and defense attorneys are, in critical respects, different from each other, and the allocation of advantages to each must be uneven in order to be fair. In a lively exploration of the powers of the prosecutor and the prerogatives of the defense, Uviller asks where our criminal justice system is fair though unequal and where its inequalities may subvert fair results. On the one hand, he points out, the prosecutor has unmatched and virtually unreviewable discretion to choose the target of a prosecution, the charge, and to a large extent the timing of an indictment. The prosecution also is first on the scene to develop evidence and is entitled to compel the production of evidence from reluctant custodians. The lawyer for the defendant, on the other hand, enjoys virtually unrestricted license to argue contrary to his or her own sincere belief, as well as broad powers to discover evidence from the prosecutor’s file. Are these unequal advantages necessary? Are they fair? Uviller concludes that although the overall criminal justice system reflects a fair distribution of advantages and disadvantages, in certain areas the imbalance is so severe as to undermine justice. He offers realistic, carefully considered recommendations for reform in these problem areas.

This original book examines the range of meaning that has been attached to the male backside in Renaissance art and culture, the transformation of the base connotation of the image to high art, and the question of homoerotic impulses or implications of admiring male figures from behind. Representations of the male body’s behind have often been associated with things obscene, carnivalesque, comical, or villainous. Few terms in political theory are as overused, and yet as under-theorized, as constitutional revolution. In this book, Gary Jacobsohn and Yaniv Roznai argue that the most widely accepted accounts of constitutional transformation, such as those found in the work of Hans Kelsen, Hannah Arendt, and Bruce Ackerman, fail adequately to explain radical change. For example, a “constitutional moment” may or may not accompany the onset of a constitutional revolution. The consolidation of revolutionary aspirations may take place over an extended period. The “moment” may have been under way for decades—or there may be no such moment at all. On the other hand, seemingly radical breaks in a constitutional regime actually may bring very little change in constitutional practice and identity. Constructing a clarifying lens for comprehending the many ways in which constitutional revolutions occur, the authors seek to capture the essence of what happens when constitutional paradigms change.
